Terms of Service

These terms cover your use of services from GOT Marketing Solutions LLC (“GOT Marketing,” “we,” “us”), a marketing agency based in Topanga, California. By signing up for our services, you’re agreeing to these terms. We’ve kept them in plain English because that’s how we do business. Questions? Email gotmarketingsolutions@gmail.com.

What We Do

GOT Marketing Solutions LLC provides marketing services for local service businesses, including:

• Marketing automation systems: missed-call text-back, review requests, lead follow-up, and related messaging automation built on our platform
• Local-SEO website services: websites built and optimized to help your business show up in local search

Services are provided on a month-to-month subscription basis. What’s included in your specific plan is spelled out when you sign up.

Service Area

We serve businesses in the United States.

Payment Terms

• Monthly subscription, billed in advance. Your card is charged at the start of each billing period for that period.
• No setup fees. The monthly price is the price.
• No long-term contract. Everything is month-to-month.
• Cancel anytime. Tell us you’re canceling (email works: gotmarketingsolutions@gmail.com) and your cancellation takes effect at the end of your current billing period. You keep your services through the period you’ve already paid for. We don’t prorate or refund partial months.

If a payment fails, we’ll let you know and attempt to collect again. If payment isn’t resolved, we may pause or end services until the account is current.

SMS / Text Messaging Terms

Some of our services involve text messaging: both messages we send to you as a client, and automated messages our systems send to your customers on your behalf. For messages from GOT Marketing Solutions LLC:

• Message frequency varies.
• Message and data rates may apply, depending on your carrier and plan.
• Reply STOP at any time to opt out of texts from us.
• Reply HELP for help, or email gotmarketingsolutions@gmail.com.
• Consent to receive text messages is not a condition of purchasing any of our services.

Your Responsibilities as a Client

To keep everything running (and legal), you agree to:

• Provide accurate business information. The business details, contact information, and registration information (such as your EIN) you give us must be accurate and up to date. Our systems, including compliant text messaging registration, depend on it.
• Use your customer lists lawfully. If you upload or provide customer contact lists for use in your automation systems, you’re confirming those contacts are yours, were collected lawfully, and that you have the right (and where required, the consent) to message them. Don’t give us purchased lists or contacts who never agreed to hear from you.
• Follow the law. Use the systems we build for you in compliance with applicable laws, including telemarketing and messaging laws (such as the TCPA) and consumer protection rules.

If your use of the services creates a legal problem, such as messaging people who never consented, that’s on you, and you agree to be responsible for claims that result from it.

Ownership

We believe you should never be held hostage by your marketing company. Here’s how ownership works:

• You always own your Google Business Profile. It’s yours, in your account, full stop. Same goes for your reviews: they belong to your business.
• You own your phone number and your domain. Any business phone number set up as part of your services is portable, and your domain stays registered to your business. If you leave, they go with you.
• Websites we build are part of your active subscription. We build, host, and maintain your website as part of your monthly service. If you cancel, hosting through us ends with your subscription. But we’ll provide reasonable transition assistance so you’re not left stranded, and your business assets (your Google Business Profile, your reviews, your phone number, your domain, your content) go with you.

No Guarantee of Rankings or Specific Results

We’re good at what we do, and we’ll be straight with you about that too: no one can guarantee a specific Google ranking, and anyone who does is lying to you. Search rankings depend on factors we don’t control, including search engine algorithms, your competition, and your market.

We commit to doing the work: building, optimizing, and maintaining your systems and site using practices designed to improve your visibility and lead flow. But results vary by business, market, and timeframe, and we don’t guarantee specific rankings, traffic numbers, lead volumes, or revenue outcomes.

Limitation of Liability

To the fullest extent permitted by law:

• Our services are provided “as is.” We don’t make warranties beyond what’s expressly stated in these terms.
• We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost business, or lost data, arising from your use of our services.
• Our total liability for any claim related to our services is limited to the amount you paid us in the three (3) months before the event giving rise to the claim.
• We are not responsible for outages, changes, or actions of third-party platforms our services depend on (such as search engines, hosting providers, messaging carriers, and software platforms), though we’ll always work to resolve issues that affect your services.

Some states don’t allow certain liability limitations, so some of the above may not apply to you.

Termination

You can cancel anytime as described under Payment Terms. We can also end or pause services if you violate these terms, use the services unlawfully, or don’t pay. We’ll communicate with you before it comes to that whenever reasonably possible.

Governing Law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any disputes will be handled in the state or federal courts located in California.

Changes to These Terms

If we update these terms, we’ll post the new version on this page and update the “Last updated” date. Continuing to use our services after changes take effect means you accept the updated terms. If a change materially affects your subscription, we’ll tell you directly.
